Welcome to Social Suite, a social media management platform developed by Mindbits. By using Social Suite, you agree to the following terms and conditions:

Use of Social Suite

You may use Social Suite only for lawful purposes and in accordance with these terms and conditions. You agree not to use Social Suite:

• In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the United States or other countries).
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate Mindbits, a Mindbits employee, another user, or any other person or entity (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing).
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Social Suite, or which, as determined by Mindbits, may harm Mindbits or users of Social Suite or expose them to liability.

Accounts and Security

You must create an account with Mindbits in order to use certain features of Social Suite. You agree to provide accurate and complete information when creating your account, and to keep your account information up-to-date. You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You agree to notify Mindbits immediately if you suspect any unauthorized use of your account or any other breach of security.

Intellectual Property

The content and materials on Social Suite, including without limitation the software, graphics, text, images, audio, videos, designs, compilations, databases, and all other content (collectively, the "Content"), are owned by or licensed to Mindbits and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use Social Suite and the Content for your own personal and non-commercial use. You may not copy, modify, distribute, sell, or lease any part of Social Suite or the Content, nor may you reverse engineer or attempt to extract the source code of any software or other component of Social Suite or the Content.

Limitation of Liability

To the fullest extent permitted by applicable law, Mindbits and its affiliates, officers, directors, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation lost profits, data loss, or cost of procurement of substitute goods or services, arising out of or in connection with your use of Social Suite or the Content, regardless of the theory of liability (tort, contract, strict liability, or otherwise), even if Mindbits has been advised of the possibility of such damages.

Modification and Termination

Mindbits reserves the right to modify, suspend, or terminate Social Suite and your access to it, in whole or in part, at any time and without notice, for any reason, including without limitation if you breach these terms and conditions. Mindbits shall not be liable to you or any third party for any such modification, suspension, or termination. Upon termination of your access to Social Suite, your right to use Social Suite and the Content shall immediately cease.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree that any dispute arising out of or in connection with these terms and conditions or your use of Social Suite shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you hereby consent to personal jurisdiction in such courts.

Entire Agreement

These terms and conditions constitute the entire agreement between you and Mindbits with respect to the use of Social Suite and the Content, and supersede all prior
